ORDERING

How to order?

• Choose the Product from our website or download our catalog and note down the Item Code, Price, Color, and/or Size and Quantity of the product/s of interest.
• Call or email our Sales Representatives about the availability of stocks. Not all items are in stock. We require all BUYERS to call and verify stock availability if they wish to pick up an item from our showroom immediately. We do keep an inventory of top-selling products.
• Read our Store Policies for any other queries or our terms and conditions covering the sale.
• Confirm the order through a Purchase Order, Fax, or Email your Order and Deposit Down Payment or Full Payment depending on the Items of interest which will confirm your order.
• Pay the Required Deposit or Full payment through one of our payment options.
• Send a Proof of Payment copy to our Representative via Email, fax, or other means possible.
• Furnish complete delivery details, address, map, and contact information.
• Full Payment is required for most products & services before delivery.

Order through FAX

• Please make sure to inquire by phone and speak to any of our Account Executives about the availability, pricing, and terms of any product of interest.
• Please create a purchase order and indicate complete details about your company or personal information.
•Please make sure the model number, color, description, quantity, and other related information are complete and stated on the purchase order.

Order Processing / Delivery Lead Time

• For common, ready-made, on-stock items, we may deliver in 1–5 days within Metro Manila if schedules are not full.
• For customized items, lead times will range from 7–30 days, depending on the products and services required.
• 30-60 days for indent/importation orders, depending on the item.
• Depending on the nature of the order, Cost U Less may be able to deliver workstations in as little as one week or even less.
• Cost U Less offers the fastest delivery and custom production lead time amongst furniture systems & interior providers.

Product Availability

• We do our best to ensure that all of the products featured in the catalog and on the website are available, but due to the large number of products we carry and the many clients and dealers we serve, there is a chance that stock is depleted but will be replenished soon.
•It would be best to confirm stock availability or the arrival schedule for items that are sold out.

Overseas Customers

• Overseas customers may order through email, Skype, or Yahoo Messenger; however, payment in full must be made before we have items reserved or sent to the address requested.
• We may include special courier fees for deliveries outside of Metro Manila, and the customer may send a money order in the name of Cost U Less Inc. or have the payment deposited at any of our payment partners.

• We accept installment payments for non-credit card holders as well, with the requirement of some documents and approval, a small processing fee, and interest.
• Discounts may be given by management depending on the products

DELIVERY & PICK UP GUIDELINES

Delivery Guidelines

• If trucks are available, delivery can be scheduled on the client’s requested day; otherwise, our Sales Executives can discuss alternative schedules.
• Our normal deliveries are scheduled from Mondays to Saturdays from 8 a.m. to 5 p.m., and logistics fees may apply.
• For any special Sunday, holiday, or evening delivery request, there may be an extra overtime fee collected.
• For the Next Day Delivery Schedules
• Orders and payments are placed before 3 p.m. only, which is a requirement for inclusion in Next Day Delivery.
• Items should be readily available/ready-made, on stock at the warehouse.
• Next-day delivery is not guaranteed and will depend on truck availability.
• Bulk orders will require more preparation time and may not be included in the next-day delivery offer unless otherwise arranged by management.
• The client has duly completed all relevant documents, including the Terms & Conditions, which he has signed on all pages.

Provincial Customers

•We deliver directly to provinces as well; this will be scheduled with an agreed-upon logistics fee throughout the Philippines.

• We may also send your order via courier or trucking services or by sea through cargo vessel services.

Pick-Up Guidelines

• For special pick up requests, client must confirm availability – see How to Order above.

• For Pick up payments are required to be paid to Makati Office and unless otherwise arranged.  An advance notice prior to pick up is required so we may have enough time to pick, prepare, Inspect, & wrap your order.

• Payment must be settled in full prior to shipping or delivery or in some cases for ready stock items in Manila Warehouse may be paid upon pick up but will not be assembled until fully paid

Delivery Fees

• Normal Fees for Metro Manila are P500-P700 per trip (Normal Office Hours 8 am to 5 pm).
• Valenzuela, Malabon, Caloocan, Rizal, Cainta, Fairview, Navotas, Taytay, Antipolo, Marikina, and other far areas will be charged P800-1000 per trip unless otherwise approved by management or a computation of delivery fee based on P40.00 per km during office hours and additional P500/hour for overtime or evening deliveries.
• Provincial Deliveries shall be on a basis for approval and fees may be given depending on the actual location. We deliver to any point in the Philippines. Logistics fee computation may be based on a reduced rate of P40.00 to P50.00 per km distance. The distance shall be computed from Taguig FTI to point of delivery and may be verified or checked through google maps.

1. What is the legal basis of the prohibition on the “No Return, No Exchange” policy of business establishments?
Under the Implementing Rules and Regulations of R.A. 7394, or the Consumer Act of the Philippines, specifically Title III, Chapter 1, Rule 2, Section 7 of Department Administrative Order (DAO) No. 2, Series of 1993, the words “No Return, No Exchange”, or words to such effect shall not be written into the contract of sale, receipt of a sales transaction, in any documents as evidence of sale, or anywhere in the store or business establishment.
2. What is the rationale for this provision?
The prohibition is aimed to correct the misconception of a lot of consumers today that they do not have the right to return shoddy or defective goods or demand remedies, in case of defective or imperfect service because of the “No Return, No Exchange” notice in the receipts or anywhere in the business establishments.
3. Why is the presence of a “No Return, No Exchange” notice considered deceptive?
Such a statement is considered deceptive because consumers may return or exchange the goods or avail of other remedies, in case of hidden faults or defects, or any charge the buyer was not aware of at the time of purchase. By provision of law, sellers are obligated to honor their implied warranties and grant corresponding remedies to consumers.
4. Can Business establishments still issue official receipts with the “No Return, No Exchange”?
The Plan has six-month objectives and three-year objectives.
Business establishments with unused Official Receipts should erase or blot out the words “No Return, No Exchange” before issuing such receipts, and henceforth, such words should no longer be printed on their receipts or anywhere in their business establishments.
5. If an item bought from store Y turns out to be more expensive than a similar item in store X, can the customer return the item and ask for a refund?
No. While consumers have the right to choose and make a canvass of prices, once a sale is done and the product has no defect, one cannot return the goods nor ask for a refund
6. Can a store exercise only a policy of exchange but not a refund?
Consumers are entitled to either an exchange or refund, as long as there is a defect in the quality of goods or an imperfection in the service.
7. If the defect is due to mishandling on the part of the buyer, can he/she still return the item and demand an exchange or refund?
No. The prohibition covers only hidden defects, shoddy goods, or imperfect service.
8. If after buying a certain item, a customer changes his/her mind and wants to return the said item. Can he/she invoke the prohibition on “No Return, No Exchange”?
No, the prohibition is not an excuse for the consumer to return the goods because of a change of mind.
9. Is there a time limit within which a buyer may return defective products?
There is no hard-and-fast rule on the period within which a customer may return the products he purchased. A rule of reason should, however, be observed, taking into consideration the nature of the item purchased and the express / implied warranties mandated by law, i.e. Consumer Act and the New Civil Code of the Philippines.
10. Can a buyer return defective goods without the official receipt?
The Official Receipt is the best proof of purchase. However, he/she may still demand a replacement or refund if he/she can prove that a defective item was bought from a certain store.
11. Can a store print in their invoices the statement “Exchange of Merchandise will not be accepted without a valid receipt or other evidence of purchase”?
~No, because there may be goods exclusively manufactured or sold by a company and there is no need to prove the purchase of the item.
12. Can a store impose the condition that merchandise can only be exchanged once?
No, because merchandise can be exchanged as many times, as long as the consumer chooses the option of replacement.
Other Return-Exchange Terms:
Clients are required to check items upon acceptance of delivery. Claims must be made within 24 hours otherwise delivery of items and services may be considered final.
Replacements will be made within 7 days only if items are not used or damaged due to misuse or abuse and must be in their original packaging with a factory defect.
Items Assembled cannot be replaced due to a change of mind or defect and part thereof will be replaced to make the item good.
For any refund of items used, (refund through a credit memo only) a fee will be collected based on the pro ratio basis of 12 months of usage, and based on the number of months used, a part of a month will be considered as 1 month. Management reserves the right to determine if a refund request is allowable depending on circumstances and should be governed by the Return & Exchange Policy of the DTI)
Cost U Less may determine if an exchange of defective products may be done after receipt of purchase. Items should be in Original packaging & not assembled or used otherwise Management reserves the right to decide if a return is acceptable. If not acceptable Cost U Less will consider items as a warranty claim and will render necessary repairs or part replacements. Other Return/Exchange Terms are governed by the DTI Consumer Act Law.

Product Warranty & Terms

• Use the product only one person at a time. Do not use the chair unless all bolts, screws and knobs are securely tightened.

• Cost U Less products are warranted for 3 months up to 10 years. Warranties are available for Office Chairs, Digital Safe movable parts, Workstations, Structural Works and most items with mechanisms and movable parts are covered with limited warranty while other items have a 7-30 days factory defect warranty. Most after sales parts are available even after warranty period and Cost U Less aims to provide best after sales service.

• Should parts fail for any covered products during normal use within the applicable warranty period, client must first provide Cost U Less with the description of the failure and proof of purchase and if necessary you may need to return defective part via a freight or other shipping charges prepaid to Cost U Less for inspection, repair and/or replacement, together with a copy of original sales receipt or Distributor/Dealer is required to bring the damaged product for inspection to any Cost U Less warehouse facility. Pictures may be sent for faster efficient evaluation of the problems so that so that Cost U Less may ready the defective parts for replacement beforehand.

• Clients are required to check items upon acceptance of Delivery. Claims must be made within 24 hours otherwise delivery of items and services may be considered final.

• Replacements will be made within 7 days only if items are not used or damaged due to mis use or abuse and must be in its original packaging with a factory defect. ( Please see Return & Exchange Policy)

• For items under warranty Cost U Less reserves the right to determine if the part damage or with defect will be replaced or the whole item. In most cases parts are available. The replacement of warranted parts is free however the items must be brought to our Service Center or Showroom and a notice is advised beforehand. Labor, delivery and installation service is not covered under warranty. If client wishes to have it serviced at their office a logistics fee may be charged or any incidental expense Cost U Less or any of its personnel may incur to be able to accomplish the inspection, repair, replacement or service of the product. Sufficient time may be required as such if parts are not available and need to be imported from the manufacturer however Cost U Less may at its option provide a service items for use until product is repaired and returned to client.

• At any instance that Cost U Less cannot repair the product or repair/replace the damage part thereof, Cost U Less may offer the client an alternative of same or slightly greater value.

• For any refund (refund only via credit memo) of items used, in any case we cannot provide a replacement, a fee will be collected based on pro ratio basis of 12months usage and based on number of months used, a part of a month will be considered as 1 months. Management reserves the right to determine if a refund request is allowable depending on circumstances and should be governed by the Return & Exchange Policy of the DTI Cost U Less may determine if an exchange of defective product may be done after receipt of purchase. Items should be in Original Packaging & not assembled or used otherwise management reserves the right to decide if return is acceptable. If items are not acceptable as a return, Cost U Less will consider items as a warranty claim and will render necessary repair or part replacements. Other Return/Exchange Terms are governed by the DTI Consumer Act Law.

Limitation of Liability

Under no circumstance, including but not limited to breach of contract, breach of warranty or negligence, shall Cost U Less be liable for lost profits, loss of goodwill, stored data, general, special, consequential or exemplary damages, even if Cost U Less had notice of these damages or they were foreseeable. Cost U Less shall not be responsible for verifying dealer’s or customer’s description of needs, data, or the fitness for a particular purpose of goods. Cost U Less’ Liability in all cases shall be limited to repair or replacement of the defective parts, or the purchase price of the product. Damages resulting from misuse, abuse, alteration, negligence, or accidents and injury are not covered under this warranty.

Risk of the Buyer – Any untoward loss or damage sustained by our products during transit, whether intentional or accidentally, or may be due to fortuitous events or Acts of God, such effects shall be on the sole account and Risk of the Buyer. As such Buyers are advised to file a claim from the shipping or freight forwarder which will be handled by the buyer with the usual support of Cost U Less only so far as witnessing the pick up, attesting to quality and completeness of goods entrusted to Shipping Company or Buyer’s Representative and supplying necessary documents as support to the claim.

For Items shipped by Cost U Less trough its own accredited trucking or shipping company, the same condition applies but rather Cost U Less may extend more support since the relationship with the accredited company may accelerate claims.

You (client/your company or a third party) agree to indemnify and hold harmless Cost U Less, its officers, directors, shareholders, employees, and agents from any actions, claims, demands, damages,  liabilities, costs, and strict liability in tort or contract, or any other legal theory arising out of the misuse or abuse, alteration, or damage in transit of the product.

Cost U Less, its officers, directors, shareholders, employees, and agents shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of our products and services.

Items sold under CLEARANCE SALE or SALE may be sold on an “AS IS WHERE IS” basis and there may be NO WARRANTY COVERAGE or a LIMITED WARRANTY or a REDUCED WARRANTY of which will be noted on the Tag or Transaction Receipt of Purchase.

EXCEPT AS OTHERWISE PROVIDED, COST U LESS MAKES NO OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Damage/Defective/Wrong Items

• Clients are required to check items upon acceptance of delivery. Claims must be made within 24 hours, otherwise delivery of items and services may be considered final.
• Replacements will be made within seven days only if items are not used or damaged due to misuse or abuse and are in their original packaging with a factory defect. (Please see our Return and Exchange Policy.)
• If the client discovers that the item is damaged or defective at the time of delivery and fails to return or agrees to return the item at the same time as delivery for reasons such as the client intending to use the item while waiting for replacement, Cost U Less may, at its discretion, determine whether the exchange is acceptable, as items not returned and used are considered sold.Items with defects are required prior to replacement, especially when the defect is seen upon delivery. Items for replacement should not be used.
• For any refund of items used (through a credit memo only), in the event we cannot provide a replacement, a fee will be collected based on a pro-rata basis of 12 months’ usage. Based on the number of months used, a part of a month will be considered as 1 month. Management reserves the right to determine if a refund request is allowable depending on circumstances and should be governed by the Return and Exchange Policy of the DTI. Cost U Less has the authority to decide whether a refund will be approved, honored, or a credit memo issued.
• Cost U Less reserves the right to determine whether a damaged or defective part will be replaced or if the entire item will be replaced if the need arises. In most cases, parts are available. Further, replacement parts and labor for items under warranty are free; the items must be brought to our service center or showroom, and a notice should be given to us beforehand. If the client wishes to have it serviced at their office or home, then a logistics fee may be charged.
•  Cost U Less may determine if an exchange or repair of a defective product may be done after receipt of the purchase. Items should be in their original packaging and not assembled; otherwise, management reserves the right to decide if a return is acceptable. Other return or exchange terms are governed by the DTI Consumer Act.

Cancellation of Order

• A 30% cancellation and/or restocking charge for canceled and returned orders/delivery charges applies and will be on the buyer’s account, which is non-refundable.
• Pick-up, delivery, logistics, permit, and overtime manpower costs will solely be on the account of the buyer and are exclusive of the cancellation charge.
• A credit memo will be issued for returns, which may be used at any time to purchase any item of the same value.
• Customized and locally sourced items are not subject to return or exchange.
• Cost U Less reserves the right to determine whether an item or items may be canceled.
• This policy is non-negotiable.
